About Us: Time.net

Time.net is an online entertainment and communication service operated and owned by e/booster limited in conjunction with Global Personals Limited (registered company number 04880697) (“Global Personals”).

e/booster limited provides a portal service access to Global Personals Limited. Full terms and conditions of use of Global Personals Limited are available from their web site, but also apply herein.

These terms and conditions (“Terms”) apply to all and any use of Time.net and specific affiliated sites, the purchase of any merchandise or services (“Products”) and all and any postings, emails, messages and other communications made to or using it or any message board or similar services run by Global Personals (“Communications”).

By using Time.net you undertake that you are over 18 years of age and are able to accept these Terms.

By using Time.net you agree to be bound by these Terms.

If you do not accept these Terms you should not use Time.net.

If you do not accept these Terms you should not make any Communications. Global Personals may make alterations to these terms and conditions from time to time and these variations shall become effective immediately upon being accessible from this page.

By using Time.net you undertake that you have the necessary hardware, software and capability required for Communications, email and web usage.


Use of Time.net

You MAY download and use Time.net solely for your private, non-commercial, personal use only.

You may not sub license or deal in this right without Time.net or Global Personals's prior written permission.

Accordingly, you undertake not to:

• use Time.net for any commercial or business purpose;
• include contact details intended to facilitate communication of any sort (email address, postal address, phone number, web address etc.) in your initial posting on Time.net (this material can be shared after you have subscribed);
• use your access to Time.net, or information gathered from it, for the sending of unsolicited bulk email.

Copyright, Trade Marks and Other Intellectual Property Rights

All copyright, design rights, database right, patents, and any rights to inventions, know-how, trade and business names, trade secrets and trade marks (whether registered or unregistered) and any applications therefor (“Intellectual Property Rights”) in Time.net belong to and vest in Global Personals, or are licensed to Global Personals unless otherwise specified. All such rights of Global Personals are hereby asserted and reserved.

You shall not:

• hack, attempt to hack, distribute, modify, transmit, re-use, re-post, or use any or all of Time.net or the information contained therein for any purpose other than as set out above;
• make any public or commercial use without Global Personals’ prior written consent;
• provide hypertext links, URL Links, graphic links, hyperlinks or other direct connection for profit or gain to Time.net without Global Personals ’s prior written permission;
• display, publish, copy, print, post or otherwise use Time.net and the information contained therein for the benefit of any third party or web site without Global Personals’ prior written consent;
• process or otherwise use the information contained on or within Time.net for any illegal or immoral purpose nor use or process the same unfairly.
• You must retain all copyright notices and other proprietary notices contained on Time.net.

Time.net

Third party web sites with links from Time.net have not been verified or reviewed by Global Personals and use and access of such third party web sites is made at your own risk.

The username and password issued to you is personal to you in order to facilitate your use of and access to Time.net and shall not be disclosed to any third party without Global Personals’ prior written consent.

All email communications sent by Global Personals and attachments thereto are intended only for the addressee and/or others authorised to receive them. Global Personals and Time.net may generate automatic emails for the purposes of information and / or entertainment. By using Time.net you agree and accept that you shall receive these messages and that not all messages or Communications which you receive may be genuine.


Communications

Time.net and Global Personals is engaged in the business of providing an entertainment and information service and ancillary to this is engaged in the transmission, storage, retrieval, hosting, formatting or translation of third party communications without selection or alteration of the content of the communication for which it is a mere conduit.

You agree and accept that Time.net and Global Personals has no responsibility to review the content of the Communications on Time.net all of which are made available on the basis that Global Personals shall not be required to exercise any control or judgement of the content or the material posted or contained therein.

The views expressed in any Communications are the views of the individual authors and not those of Global Personals unless specified otherwise by Global Personals. In particular but without limitation to the above Global Personals is not responsible for and disclaims all liability in respect of any comments, views or remarks expressed in any Communications.

Global Personals gives no warranty and makes no representation as to the accuracy, currency or validity of the information and material contained within the Communications or Time.net and shall not be responsible for any loss or damage caused as a result of any use of such material.

• You agree and undertake that you will not post to or transmit to Time.net any statement, material or Communication that:
• is unlawful or which gives rise to civil or criminal liability;
• infringes upon the intellectual property rights of any third party.
• is technically harmful such as computer viruses, worms, logic bombs or other malicious software or harmful data;
• is abusive, pornographic, aggressive, defamatory, libellous, untrue, discriminatory, obscene, inflammatory or racist material whatsoever;
• harasses any person;
• may be deemed a marketing or commercial communication or promotes the products or services of any person other than Global Personals or Time.net;
• promotes any illegal or unlawful activity including but not limited to solicitation, gambling or the sale of prescription medicines;
• is aimed at persons under the age of 18 or which seeks or attempts to make any arrangement to meet a child under the age of 16 with intent to abuse them sexually or which may have such a meeting as its object or effect;
• contains any restricted material, including nut not limited to passwords, medical information or confidential information of any person; or
• solicits, invites, encourages, advocates, incites or provokes any or all of the foregoing.

You further agree that in any activity undertaken following use of and related to your use of Time.net you will not in any way conduct yourself in a manner which is unlawful or which gives rise to civil or criminal liability or which might call into disrepute Time.net.

You agree to indemnify and hold harmless e/booster limited and Global Personals against all liability it may have in respect of and arising out of your use of the Global Personals Services and your Communications.

Global Personals shall be entitled to remove or restrict any Communications which it determines in its sole and absolute discretion might be unacceptable including as described in these Terms.


Please Note

You use Time.net at entirely your own risk. It is a known risk of internet usage that people are not necessarily who they say they are. Users must be over 18 years old but people may provide information or behave in a way that is unreliable, misleading, unlawful or illegal. Global Personals have no way of telling if statements made by other visitors are true. This is a decision that can only be made at your discretion and the exercise of some degree of caution is recommended. By using Time.net and its services you accept that this is the case and accept the risk associated therewith. Time.net ask that users take particular care in relation to the disclosure of their own personal information including surname, address, email address, telephone number, place of work and places they go out.


Privacy and Data Policy

Time.net makes a commitment to protecting your privacy and promises only to use information collected about you in accordance with the Data Protection Act 1998.

When you subscribe or sign up to Time.net, Global Personals may ask you for certain information and you may submit personal data to Time.net (for example your name, phone number, postal address, email address, contact and bank / credit card details). Global Personals may also record which services you are interested in and which services you purchase as well as user traffic patterns and site use. This information will be kept securely in accordance with an internal security policy and may be used to:

• process your Communications, your subscription to Time.net and to enable your use of Time.net and the services;
• provide you with an up to date, efficient and reliable service;
• help fraud prevention i.e. Global Personals check card details with credit agencies and reserve the right to refuse to make available the Time.net services on that basis (your credit rating can be checked for a nominal fee with the main UK agencies Equifax and Experian);
• open and run your account;
• administer prize draws;
• generally run the Time.net service

By subscribing and submitting your data you agree to this use.

From time to time Global Personals also monitor and record telephone calls for training purposes and to improve the service to you.

Global Personals will never collect sensitive information about you without your explicit consent.


Marketing Communications

If you have used the Time.net web site before it is possible that Global Personals have this information already and it is being used to contact you about offers, events, items or related activities that you may find useful. If you are an existing customer Global Personals will continue to keep you informed unless you tell us not to.

If you are a new customer Global Personals will give you the choice (for example once you have subscribed or signed up) whether or not you want us or other reputable companies to contact you about future offers, events and new services or related activities that you may find useful. Global Personals will not bombard you with emails, but Global Personals would like to keep you informed of the developments on Time.net.

Global Personals and Time.net do not sell, trade or rent your personal information to other companies but from time to time may want to share data with other reputable companies both within and outside the European Union who may have interesting offers and information for you. Global Personals and Time.net will not send you any marketing emails or pass your information on to third parties unless you give your consent or you have given it already.

Where requested please therefore check the relevant box marked:

• I would like to receive information from Time.net in future” if you wish to receive future information from Time.net;
• I would like to receive information from interesting third parties” if you want us to pass the information on to third parties.

Cookies

In order to improve the service and Time.net, Global Personals may use a device known as a ‘cookie’. Cookies are a means by which information relating to your Internet activity (such as whether you have visited Time.net before) is recorded on your hard drive and used by us to improve Time.net and the services and services available to you.

If you do not wish for us to use cookies when you use Time.net please adjust your Internet browser settings to not accept cookies. Your computer’s help file should tell you how to do this. PLEASE NOTE: This may affect your ability to use Time.net and its services.

Unless you disable “cookies” the Time.net web site will ask for and store details including name, address and bank details and may automatically insert certain information on the subscription or Communications forms so that you can use Time.net with the minimum amount of form filling.


Your Privacy

If you have any questions or comments about privacy or the Time.net privacy policy, or if you already have submitted information that you do not wish us to have or if you think that Time.net has cookies or data about you that you don’t want us to use or that is incorrect please contact us at the address below, by email (at info@whitelabledating.com) and the information will be corrected as soon as possible or removed from the database as you request.

Global Personals is registered with the Information Commissioner in accordance with the Data Protection Act 1998.


Payment

Time.net is free to visit and view however in order to communicate with other members, you must subscribe and pay the relevant charges (as notified to you from time to time including by clicking here), complete the appropriate online form and submit your request or order. When you submit your request or order it will be deemed an offer to purchase the relevant services for the price stated.

Payment may be made online, or over the phone, using a credit or debit card (currently VISA, MasterCard, American Express, Delta and Switch/Solo).

Global Personals aim to debit money from your account within one working day after receiving your purchase request.

To ensure that shopping on-line is secure, your credit/debit card details will be encrypted to minimise the possibility of someone being able to read them as they are sent over the Internet.

Your credit card company may also do security checks to confirm it is you making the order.

From time to time it may become necessary for Global Personals to make alterations to the charges, prices and fees. In the event of any such change Global Personals shall publish these on Time.net and they shall become effective immediately upon publication.

You will not be charged for any request that cannot be fulfilled and where appropriate Global Personals will use all reasonable efforts to re-credit to your account or otherwise refund any sum debited by Global Personals on request.

All prices are quoted in pounds sterling and include V.A.T and delivery costs.

Time.net does not accept cash, cheque or money order.

Time.net may cancel any sale and not supply services if it is reasonable to do so and may change or discontinue the availability of items at any time at its sole discretion.

You may cancel your purchase of any services at any time up to the end of the 7th working day after that purchase order has been made, except where you have taken advantage of or used the service. Once notified, Global Personals shall, as soon as possible, where appropriate, use all reasonable efforts to procure that the charge does not appear on your credit card bill in respect of those services and cancel your access to those services on Time.net or otherwise refund such sum as is charged on request.


Liability

Global Personals provides and maintains Time.net for personal entertainment, on an “as is” basis.

Global Personals shall be liable only to provide its services with reasonable skill and care and gives no other warranty in connection with Time.net.

Subject as aforesaid, to the maximum extent permitted by law, Global Personals excludes liability for any loss or damage of any kind howsoever arising, including without limitation any direct, indirect, punitive or consequential loss whether or not such arises out of any problem you notify to Global Personals and Global Personals shall have no liability to pay any money by way of compensation, including without limitation all liability in relation to:

• any incorrect or inaccurate information on Time.net and all interruptions to or delays in updating the service;
• the infringement by any person of any Intellectual Property Rights of any third party caused by their use of Time.net;
• any amount or kind of loss or damage due to viruses or other malicious software that may infect a user's computer equipment, software, data or other property caused by persons accessing, using or downloading Time.net, or from transmissions via emails or attachments received from Global Personals or its licensees
• the availability, quality, content or nature of the other sites on the internet that are owned and operated by third parties ("External Sites") to which Time.net link and web site located on or through any External Site nor for any transactions involving External Sites (including as to 'cookies', personal data, confidential information, or purchases of domain names or other services). You should contact the site administrator or webmaster for those External Sites if you have any concerns regarding such links, web site or transactions;
• all representations, warranties, conditions and other terms which but for this notice would have effect.
• Global Personals does not warrant that the operation of the Time.net will be uninterrupted or error free.
• These terms above shall not limit any rights you might have as a consumer that may not be excluded under applicable law nor shall it exclude or limit Global Personals’ liability for death or personal injury resulting from its negligence nor any fraudulent representation.

Termination

Global Personals shall be entitled to terminate this Agreement and immediately remove, cancel or suspend access to and use of Time.net upon your breach of any part of these Terms whatsoever.

Termination shall be without prejudice to the accrued rights of either party.

Global Personals will not be liable in any amount for failure to perform any obligation under this agreement if such failure is caused by the occurrence of any unforeseen contingency beyond the reasonable control of such party including without limitation Internet outages, communications outages, fire, flood, war or act of God.


General

Except as provided above there are no other warranties, conditions or other terms, express or implied, statutory or otherwise, and all such terms are hereby excluded to the maximum extent permitted by law (but subject to your statutory and common law consumer rights).

e/booster limited and Global Personals act as principals on their own account and not as agent(s) for you or any other person.

If e/booster limited and Global Personals does not enforce any provision of this agreement such will not be considered a waiver of any provision or right.

In the event that any part of these terms and conditions is held to be unenforceable, such part will at e/booster limited and Global Personals’ option be construed as far as possible to reflect the parties’ intentions and the remainder of the provisions will remain in full force and effect.

These terms and conditions constitute the entire agreement between you, e/booster limited and Global Personals and shall apply to the exclusion of all other terms or conditions of contract which you may purport to propose.

Use of e/booster limited / Global Personals and these terms are subject to the laws of England which shall exclusively govern the interpretation, application and effect of all the above permissions, exclusions, licences and conditions of use and shall be construed in accordance with the laws of England and the parties submit to the exclusive jurisdiction of the English courts.

It is hereby asserted that Time.net is intended for and directed at the UK and no representation or warranty is made as to whether Time.net complies with the regulatory regime and local laws of any other countries.
